What is the Small Claims Court?

The Small Claims Court was designed to be more accessible to the public, faster, and less formal compared to proceedings in the Superior Court of Justice. It was created to settle minor civil disputes between parties, including matters in tort and in contract law. A proceeding in the Small Claims Court allows you to sue, or be sued, for the recovery of property or for an amount up to $35,000.00 plus costs and interest.

Do I need a lawyer or paralegal?

While it is not necessary to hire a legal representative, the legal process can be complex and daunting to those unfamiliar with its timelines and procedures. In our experience, self-represented litigants involved in the proceeding may be too emotionally invested to effectively and clearly manage the evidence and claims against them.

We understand the costs of legal fees may be at the forefront of many parties’ reservations. However, the Small Claims Court may award costs up to 15% of the claim. While awards of costs are not a guarantee, it may allow you to recuperate up to $3,750.00 for legal advice and expertise.
